Člen – Uporaba
1.1 Poleg določil in pogojev, navedenih na spletni strani ("Določila in pogoji promocije" in "Specifična določila in pogoji"), veljajo za vse ponudbe digitalnih in drugih spletnih storitev podjetja Clickzillas B.V., ki se izvajajo prek mobilnih operaterjev ("Operater") in za katere uporabnik sklene naročnino ("Mobilna naročnina"), tudi ta splošna določila in pogoji, ne glede na to, ali so storitve podrobno opisane v teh dokumentih ali ne. Digitalne in druge storitve, ki jih zagotavlja Clickzillas B.V., vključujejo igre, besedilna sporočila, zvok, slike in/ali podobne storitve ("vsebinske storitve"), ki se dostavljajo prek operaterjevega omrežja z uporabo sistema kratkih sporočil ("SMS"), mobilnih podatkovnih storitev ("GPRS") in/ali storitev tretje generacije ("3G").

2.1 Končni uporabnik zahteva vsebinske storitve pri Clickzillas B.V., ki jih dostavi uporabniku prek operaterjevih storitev in omrežja.
Člen – Stroški
3.1 Oglasi ali vsebine na spletni strani www.clickzillas.com ("Spletna stran") ne predstavljajo obveznosti, razen če je v ponudbi izrecno navedeno drugače.
3.2 Stroški vsebinskih storitev za (i) naročniške storitve in (ii) enkratna naročila so opredeljeni v "Specifičnih določilih in pogojih". Zneski se zaračunajo prek operaterja ali bremenijo uporabnikov predplačniški kredit. Uporabnik za to izrecno daje soglasje.
3.3 Stroški se lahko obračunajo za vsako poslano ali prejeto sporočilo, odvisno od vrste storitve in načina plačila. Operater lahko zaračuna standardne stroške SMS sporočil. Za uporabo storitev je lahko zahtevano tudi enkratno plačilo ob registraciji. Podrobne informacije o stroških in načinih plačila so dostopne v razdelku Pogosta vprašanja (FAQ) in/ali v Določilih in pogojih uporabnika.
Člen – Spremembe cen
4.1 Clickzillas B.V. si pridržuje pravico do spremembe cen, o čemer objavi obvestilo na spletni strani. Obstoječi uporabniki prejmejo SMS obvestilo najmanj teden dni pred uveljavitvijo novih cen. Nadaljnja uporaba storitev po datumu spremembe pomeni soglasje s spremenjenimi cenami.
Člen – Nagrade
5.1 Kampanje z istimi nagradami se lahko oglašujejo prek različnih začetnih strani, ki se razlikujejo po oblikovanju (barvah, videzu ipd.).
5.2 Enaka kampanja z istimi nagradami se lahko oglašuje na različnih napravah (računalnik, mobilni telefon, tablica ipd.).
5.3 Brezplačen prijavni obrazec je na voljo na naslovu: help@clickzillas.com. Do nagrade so upravičeni samo udeleženci, ki v največ 50 besedah navedejo, zakaj si želijo nagrado. Ob koncu promocijskega obdobja se izbere zmagovalec med vsemi veljavnimi prijavami. Zmagovalec bo obveščen v treh tednih po zaključku promocijskega obdobja. Za izvedbo nagradne igre je potrebnih najmanj 100 udeležencev.
5.4 Izbor zmagovalca nadzira notar.
Člen – Prenehanje in odpoved
6.1 Načini prenehanja uporabe vsebinskih storitev so določeni v Določilih in pogojih uporabnika. Prekinitve so veljavne le v skladu s temi pravili.
6.2 Prenehanje naročniških storitev je potrjeno s SMS sporočilom, ki ga prejme uporabnik. Strošek takega sporočila krije uporabnik.
6.3 Clickzillas B.V. lahko nemudoma prekine vse storitve, če:
(a) uporabnik ne poravna stroškov v zahtevanem roku;
(b) Clickzillas B.V. upravičeno domneva, da uporabnik krši ta določila;
(c) to zahteva operater;
(d) veljavna zakonodaja, pravila ali odločitve oblasti storitev onemogočijo;
(e) uporabnik ogroža integriteto ali delovanje omrežja Clickzillas B.V.
6.4 Clickzillas B.V. ne odgovarja za škodo zaradi prekinitve storitev.
6.5 V primeru prekinitve naročnine uporabnik ni upravičen do povračila stroškov. Preostali krediti pri enkratnih storitvah ostanejo uporabniku.
6.6 Clickzillas B.V. ne prevzema odgovornosti do uporabnikov ali tretjih oseb zaradi prekinitve ali odpovedi storitev.
6.7 Clickzillas B.V. si pridržuje pravico zamenjati izdelek z enakovrednim brez predhodnega obvestila.
Člen – Intelektualna lastnina
7.1 Če ni določeno drugače, so vse avtorske in druge pravice intelektualne lastnine v zvezi s storitvami in spletno stranjo last podjetja Clickzillas B.V., njegovih dobaviteljev ali pogodbenih partnerjev.
7.2 Uporabniku se podeli omejena, neizključna, neprenosljiva in preklicna pravica do prenosa in uporabe vsebinskih storitev.
7.3 Brez pisnega dovoljenja Clickzillas B.V. uporabnik ne sme reproducirati, spreminjati, distribuirati, prodajati ali drugače uporabljati vsebin.
7.4 Uporabnik je odgovoren za kršitve pravic intelektualne lastnine in se zavezuje povrniti škodo Clickzillas B.V. ter povezanim osebam v primeru takih kršitev.
Člen – Odgovornost
8.1 Uporaba storitev in spletne strani je na lastno odgovornost uporabnika. Clickzillas B.V. ne jamči za neprekinjeno in brezhibno delovanje.
8.2 Mobilne storitve so lahko začasno nedostopne zaradi fizičnih ovir, vzdrževanja ali drugih tehničnih razlogov.
8.3 Nezmožnost uporabe storitev ne daje pravice do povračila plačil ali znižanja cene.
8.4 Clickzillas B.V. ne odgovarja za škodo na strojni ali programski opremi uporabnika zaradi uporabe storitev.
8.5 V primeru odgovornosti je nadomestilo omejeno na višino računa za storitev, ki je povzročila škodo.
8.6 Kljub skrbnosti Clickzillas B.V. ne zagotavlja popolne točnosti informacij na spletni strani in ne odgovarja za napake ali zamude pri prenosu podatkov.
8.7 Uporabnik ne sme pošiljati nezakonitih, škodljivih ali neprimernih sporočil, ki bi lahko povzročila škodo Clickzillas B.V.
8.8 Uporabnik mora biti star najmanj 18 let ali imeti soglasje plačnika mobilnih storitev (npr. starša, skrbnika, delodajalca).
Člen – Obdelava podatkov
9.1 Clickzillas B.V. zbira in obdeluje osebne in prometne podatke uporabnika.
9.2 Obdelava poteka v skladu s Politiko zasebnosti, objavljeno na spletni strani, ob upoštevanju veljavne zakonodaje.
9.3 Clickzillas B.V. si pridržuje pravico do uporabe kontaktnih podatkov uporabnika (mobilna številka, e-pošta ipd.) za promocijske namene.
Člen – Uporaba zakona
10.1 Za storitve, pogodbo in spletno stran velja pravo države, v kateri poteka kampanja. Če je določba razglašena za neveljavno, ostanejo preostale določbe v veljavi.
10.2 Za vse spore je pristojno sodišče v Ljubljani.
Člen – Končne določbe
11.1 Clickzillas B.V. si pridržuje pravico spremeniti ta določila. Uporabniki bodo o spremembah obveščeni na spletni strani. Nadaljnja uporaba storitev pomeni sprejem sprememb.
11.2 Uporabnik lahko kadarkoli zahteva kopijo teh določil.

Article – Usage
1.1 In addition to the terms and conditions listed on the website ("Promotion Terms and Conditions" and "Specific Terms and Conditions"), these general terms and conditions apply to all offers of digital and other online services by Clickzillas B.V., which are provided through mobile operators ("Operator") and for which the user enters into a subscription ("Mobile Subscription"), regardless of whether the services are described in detail in these documents or not. Digital and other services provided by Clickzillas B.V. include games, text messages, sound, images and/or similar services ("content services") that are delivered through the operator's network using short message system ("SMS"), mobile data services ("GPRS") and/or third generation services ("3G").
Article – Delivery of Content Services
2.1 The end user requests content services from Clickzillas B.V., which delivers them to the user through the operator's services and network.
Article – Costs
3.1 Advertisements or content on the website www.clickzillas.com ("Website") do not represent obligations, unless otherwise explicitly stated in the offer.
3.2 Costs of content services for (i) subscription services and (ii) one-time orders are defined in "Specific Terms and Conditions". Amounts are charged through the operator or debited from the user's prepaid credit. The user explicitly gives consent for this.
3.3 Costs may be charged for each sent or received message, depending on the type of service and payment method. The operator may charge standard SMS message costs. A one-time payment upon registration may also be required for using the services. Detailed information about costs and payment methods is available in the Frequently Asked Questions (FAQ) section and/or in User Terms and Conditions.
Article – Price Changes
4.1 Clickzillas B.V. reserves the right to change prices, about which it will publish a notice on the website. Existing users will receive an SMS notification at least one week before the implementation of new prices. Continued use of services after the change date means agreement with the changed prices.
Article – Prizes
5.1 Campaigns with the same prizes may be advertised through different landing pages that differ in design (colors, appearance, etc.).
5.2 The same campaign with the same prizes may be advertised on different devices (computer, mobile phone, tablet, etc.).
5.3 A free application form is available at: help@clickzillas.com. Only participants who explain in a maximum of 50 words why they want the prize are entitled to the prize. At the end of the promotional period, a winner is selected from all valid applications. The winner will be notified within three weeks after the end of the promotional period. A minimum of 100 participants is required to conduct the prize game.
5.4 The selection of the winner is supervised by a notary.
Article – Termination and Cancellation
6.1 Methods of terminating the use of content services are defined in User Terms and Conditions. Terminations are valid only in accordance with these rules.
6.2 Termination of subscription services is confirmed by an SMS message received by the user. The cost of such a message is covered by the user.
6.3 Clickzillas B.V. may immediately terminate all services if:
(a) the user does not settle costs within the required period;
(b) Clickzillas B.V. reasonably suspects that the user violates these terms;
(c) the operator requires it;
(d) applicable legislation, rules or authority decisions prevent it;
(e) the user threatens the integrity or operation of the Clickzillas B.V. network.
6.4 Clickzillas B.V. is not liable for damage due to service termination.
6.5 In case of subscription termination, the user is not entitled to cost refunds. Remaining credits for one-time services remain with the user.
6.6 Clickzillas B.V. does not assume responsibility to users or third parties due to service termination or cancellation.
6.7 Clickzillas B.V. reserves the right to replace the product with an equivalent without prior notice.
Article – Intellectual Property
7.1 Unless otherwise specified, all copyright and other intellectual property rights related to services and the website are the property of Clickzillas B.V., its suppliers or contractual partners.
7.2 The user is granted a limited, non-exclusive, non-transferable and revocable right to transfer and use content services.
7.3 Without written permission from Clickzillas B.V., the user may not reproduce, modify, distribute, sell or otherwise use content.
7.4 The user is responsible for violations of intellectual property rights and undertakes to compensate Clickzillas B.V. and related persons for such violations.
Article – Liability
8.1 Use of services and the website is at the user's own risk. Clickzillas B.V. does not guarantee uninterrupted and flawless operation.
8.2 Mobile services may be temporarily unavailable due to physical obstacles, maintenance or other technical reasons.
8.3 Inability to use services does not give the right to payment refunds or price reductions.
8.4 Clickzillas B.V. is not liable for damage to the user's hardware or software due to service use.
8.5 In case of liability, compensation is limited to the amount of the service bill that caused the damage.
8.6 Despite care, Clickzillas B.V. does not guarantee complete accuracy of information on the website and is not liable for errors or delays in data transmission.
8.7 The user may not send illegal, harmful or inappropriate messages that could cause damage to Clickzillas B.V.
8.8 The user must be at least 18 years old or have consent from the mobile service payer (e.g., parent, guardian, employer).
Article – Data Processing
9.1 Clickzillas B.V. collects and processes personal and traffic data of the user.
9.2 Processing is carried out in accordance with the Privacy Policy published on the website, taking into account applicable legislation.
9.3 Clickzillas B.V. reserves the right to use user contact data (mobile number, email, etc.) for promotional purposes.
Article – Applicable Law
10.1 The law of the country where the campaign takes place applies to services, contract and website. If a provision is declared invalid, the remaining provisions remain in force.
10.2 The court in Ljubljana has jurisdiction over all disputes.
Article – Final Provisions
11.1 Clickzillas B.V. reserves the right to change these terms. Users will be notified of changes on the website. Continued use of services means acceptance of changes.
11.2 The user may request a copy of these terms at any time.
11.3 Clickzillas B.V. has its headquarters in Maastricht and is registered with the Chamber of Commerce under number 67773230, VAT: NL857168666B01.
